1. WEBSITE: Discover Worship (“the Site”) is an online subscription service owned by Belden Street Music Company, an Oregon LLC. The website and its contents are protected by federal and international copyright and trademark laws.
2. MEMBERSHIP: While you may set up a free account to preview music on our Site, you may only download and reprint music if you are a subscribing member. You must be at least 13 years of age to use the Site and must provide complete and accurate information when signing up.
3. PAYMENT & RENEWALS: Subscriptions may be paid by debit/credit card, e-check or billed invoice. In order to maintain continuity of service, monthly and annual subscriptions paid by card will automatically renew unless modified by the subscriber. It is your responsibility to monitor the status of your subscription.
4. REFUNDS & CANCELLATIONS: Cancellations may by made on our website or by calling us. Full refunds are available within 15 days of purchase, provided no music or resources have been downloaded. The same policy applies to automatic subscription renewal payments, minus a fee (usually 15% or less) to cover any costs assessed by our credit card processing company.
5. CHANGES IN PRICE: Active subscriptions will renew under the regular price in effect at the time of initial purchase, as long as recurring payment continues without interruption. If your membership lapses for any reason, new subscriptions will be based on the then-current price. Notwithstanding the above, we reserve the right to change our prices at any time.
6. CHANGES IN TERMS: Any revisions to our Terms and Conditions will be posted on our Site and you agree that each new visit to this Site is a new transaction governed by the “Terms of Use” linked on this Site at that time.
7. OWNERSHIP: All the material on our Site remains property of Belden Street Music and our affiliates or the companies from whom it was leased. You are essentially leasing—not owning—the materials you download.
8. NON-TRANSFERABLE: Your subscription is a license that allows you to make printed copies for the singers and musicians in your local church only. Churches with more than one campus must purchase separate subscriptions for each campus.
9. SHARING PROHIBITED: While you may share your subscription with other members of your immediate team, sharing your subscription or downloaded materials with other churches is expressly prohibited. Likewise, a subscription is site-specific and does not transfer with you when you leave.
10. PERFORMANCE LICENSE: Your subscription does not entitle you to record our music for sale or broadcast. Also, you are still required to procure a public performance license for the songs through CCLI.
11. ROYALTIES: We negotiate royalty compensation with the song and master owners so that you may download and duplicate these songs. This music is NOT royalty-free and should always be treated as the property of others.
12. CATALOG: We regularly add songs, musicals and collections to our library. We retain the right to adjust the quantity and frequency of new additions as our business model evolves. On rare occasions, a contract for a given song may expire and that composition may no longer be available on our Site.
13. CONFIDENTIALITY & SECURITY: We do not store confidential or proprietary information on our Site. Financial transactions are handled through Authorize.net, a highly secure, certified third-party payment processor that encrypts all transactions.
14. ASSUMPTION OF RISK: You assume any and all potential risks involved in using an online service, clicking through any hyperlinks and/or downloading files from our Site. We (and our affiliates) are not responsible for any direct or indirect loss or damage that may result from using the Site—including damage from hidden viruses or malware or hacking of our third-party payment processor.
15. PRIVACY POLICY: You acknowledge that our Privacy Policy is posted on the site for your review and reference.
16. ABUSE OF SERVICES: You agree not to use the Site for any purpose that is unlawful or prohibited by these Terms and Conditions. We may suspend or terminate access to the Site to anyone at any time for any reason, especially if individuals give false or misleading registration information. For annual subscribers, there is a daily limit of 25 downloads.
17. ACCURACY: Although we strive for accuracy of all information on our Site, it may contain errors that we will seek to reasonably correct if you’ll inform us by email.
18. POSTING ON OUR SITE: We invite constructive responses to our blogs and products, but retain the right not to post information or material submitted to us for any reason. Likewise, when you submit anything to our Site for posting, you are giving us the unrestricted and royalty-free right to use that material in any manner we see fit.
19. MISC: The laws of the State of Tennessee govern these Terms and Conditions. If any part of this Agreement is held invalid or unenforceable, the remaining portions shall remain in effect. Our failure to enforce any right or provision doesn’t mean we’ve waived that or any other provision. Belden Street Music will not be responsible for failures to fulfill any obligations due to causes beyond our control.
